With the delicious testimonies of Disney CEO Michael Eisner and erstwhile superagent/president-for-a-minute Michael Ovitz fading from memory, the heat on The Hollywood Trial of the Century has all but dissipated. While Ovitz's pathological denial made him feel his time on the witness stand helped to rehabilitate his battered rep around town (being called a "psychopath" isn't so bad, right?), he took another beating in Tuesday's proceedings, when former Disney chief legal counsel branded Ovitz a "total failure." As if this tarring wasn't enough, Litvack dumped the feathers on the ex-president's head, sneakily impugning Ovtiz's vaunted lying ability by claiming that he never lied about any "material" issues while at the Mouse.

While Ovitz tried to evoke a sepia-toned image of the two "life partners'" running Disney while placidly floating in a rowboat, executive limbs intertwined, breaking their clasp only when Ovitz would sit up to readjust the parasol protecting his CEO from the midday sun, Eisner did his best to portray their union as strictly take-the-cab-fare-and-try-not-to-wake-me-on-the-way-out: "I was amused by him," Eisner said. "He was fun to go to dinner with."

CNBC's documentary on the AOL/Time Warner merger, titled "The Big Heist," is one big lesson in C-level schadenfreude. The big media big boys Sumner Redstone, John Malone, Michael Eisner, etc., can barely contain their glee as they talk about The Deal They Didn't Do. Levin is ultimately exhonerated for being an all-around nice guy, while Case is portrayed as the evil mastermind behind the operation. Case, according to ex-boss James Kimsey, has no intention of going anywhere.
